U.S. Government Sues Uber Over Alleged Disability Discrimination
The U.S. federal government has launched a significant legal challenge against Uber, the nation’s largest ride-hailing company. A lawsuit filed on Friday accuses the tech giant of systemic discrimination against passengers with disabilities. The Department of Justice alleges that Uber drivers have repeatedly violated federal law, denying essential transportation services to disabled individuals and imposing illegal charges.
Allegations of Systemic Discrimination
According to the lawsuit, filed in federal court in Northern California, Uber drivers have routinely refused rides to passengers accompanied by service animals, including guide dogs. Beyond outright denials, the complaint details instances where drivers allegedly imposed illegal cleaning fees, citing service animal shedding, and unjustly applied cancellation fees after unilaterally refusing service.
The legal action further highlights cases where disabled individuals were denied the ability to sit in the front seat, a crucial accommodation for safely stowing mobility devices like walkers, crutches, and folding wheelchairs in the back.
Profound Impact on Disabled Passengers
The consequences of these alleged discriminatory practices, as outlined by the Department of Justice, have been severe for disabled passengers. Many have reportedly missed critical appointments, endured significant delays in their travel, and found themselves stranded in adverse weather conditions.
Assistant Attorney General Harmeet Dhillon of the Justice Department’s Civil Rights Division underscored the gravity of the situation, stating, “For too long, blind riders have suffered repeated ride denials by Uber because they are traveling with a service dog. This lawsuit seeks to end this persistent discrimination and allow riders with disabilities to use Uber.”
Uber Responds to Allegations
In response to the lawsuit, Uber issued a statement Friday, asserting its disagreement with the allegations. The San Francisco-based company emphasized that all its drivers are required to acknowledge and comply with its stringent service animal and accessibility policies. These policies explicitly prohibit drivers from denying service to individuals with service animals and mandate that drivers provide transportation to any person with a disability who can independently enter the vehicle.
Furthermore, Uber’s guidelines require drivers to assist passengers with stowing mobility aids such as walkers, crutches, and folding wheelchairs. The company reiterated its commitment, stating, “Riders who use guide dogs or other assistive devices deserve a safe, respectful and welcoming experience on Uber — full stop.”
Legal Ramifications and Company Actions
To address reported violations, Uber established a dedicated hotline in 2023 for customers who experience ride denials due to a service animal. The company claims it investigates these reports and takes appropriate action, including the deactivation of a driver’s account, when violations are confirmed.
The Department of Justice is seeking substantial financial redress, demanding $125 million in damages for disabled individuals who have previously lodged complaints with either Uber or the Department of Justice regarding these discriminatory incidents.
