NEW YORK — A federal judge has issued a stern warning to the Justice Department, stating that at least two senior officials likely violated court rules by publicly endorsing former President Donald Trump’s characterization of Luigi Mangione, the man accused of assassinating UnitedHealthcare CEO Brian Thompson, as a “pure assassin.” U.S. District Judge Margaret M. Garnett, presiding in New York, warned on Wednesday that future infractions could lead to severe penalties, including “personal financial penalties, contempt of court findings, or relief specific to the prosecution of this matter.”

The Controversial Endorsement

The controversy stems from comments made by former President Trump during a September 18 appearance on Fox News, where he unequivocally declared Mangione “a pure assassin.” Trump added, “He shot someone in the back as clear as you’re looking at me. He shot him right in the middle of the back, instantly dead.” A video clip of these remarks, initially posted by the White House on social platform X, was subsequently reposted by Chad Gilmartin, a Justice Department spokesperson, who added the comment, “@POTUS is absolutely right.” This post, later deleted, was then reposted by Brian Nieves, an associate deputy attorney general.

Breach of Court Rules and Demand for Explanation

Judge Garnett emphasized that these actions likely breached a local rule specifically designed to prevent prosecutors from making public statements about a defendant’s guilt or innocence before trial, thereby safeguarding the integrity of the legal process and ensuring a fair trial. The judge has demanded an explanation from the Justice Department regarding these violations and the preventative measures being implemented. The Justice Department declined to comment on the matter.

Defense Lawyers’ Prior Concerns and Death Penalty Pursuit

This judicial rebuke follows earlier concerns raised by Mangione’s defense lawyers, who previously sought to dismiss federal charges and remove the possibility of the death penalty. Their argument centered on what they described as prejudicial public statements and actions by Justice Department officials, including U.S. Attorney General Pam Bondi. Prior to Mangione’s April indictment, Bondi publicly stated that capital punishment was warranted for a “premeditated, cold-blooded assassination that shocked America,” and formally directed Manhattan federal prosecutors to pursue the death penalty.

The defense team, in a written submission to Judge Garnett, argued that Bondi’s statements, combined with other official actions such as a “highly choreographed perp walk” of Mangione, and alleged deviations from established death penalty procedures by the Trump administration, “have violated Mr. Mangione’s constitutional and statutory rights and have fatally prejudiced this death penalty case.”

The Charges Against Luigi Mangione

Luigi Mangione has pleaded not guilty to both state and federal charges in the December 4 shooting death of Brian Thompson. Thompson was fatally shot as he arrived at a Manhattan hotel for his company’s annual investor conference. In the federal case, Mangione faces charges including murder through use of a firearm, stalking, and gun offenses, with the murder charge carrying the potential for the death penalty.

Allegations of Links to Political Extremism

Adding to their grievances, Mangione’s lawyers sent a letter to Judge Garnett on Tuesday, alleging ongoing prejudice due to the government’s continued association of their client with political extremism. They cited instances where Mangione was described by White House officials as a “left wing assassin” and “anti-fascist,” and was referenced in a press release designating Antifa as a terrorist organization.

“The Government has indelibly prejudiced Mr. Mangione by baselessly linking him to unrelated violent events, and left-wing extremist groups, despite there being no connection or affiliation,” the lawyers asserted. They explicitly stated, “Mr. Mangione in fact does not support these violent actions, does not condone past or future political violence, nor is he in any way aligned with the group mentioned in the White House press release.”

A History of Judicial Rebuke

This is not the first instance of a Manhattan federal judge admonishing Justice Department officials for public comments in a high-profile criminal case. In April 2015, Judge Valerie Caproni criticized then-U.S. Attorney Preet Bharara for approaching “the edge of the rules governing his own conduct” when he announced corruption charges against former Democratic New York Assembly Speaker Sheldon Silver. Caproni suggested it was not unreasonable for Silver to claim the “media blitz” surrounding his arrest was prejudicial. Silver was ultimately convicted and sentenced to over six years in prison, later dying in federal custody in January 2022 at the age of 77.
